WILL Files Friend-of-the-Court Brief on Behalf of WI Parents

Wisconsin Institute for Law and Liberty, representing the Empowered Community Coalition, recently filed a friend-of-the-court brief in the Seventh Circuit Court of Appeals. Currently, the Seventh Circuit is reviewing two Wisconsin cases that previously gave permission to biological males who identify as transgender to use girls’ bathrooms and locker rooms in public schools. WILL’s brief urges the court to overturn both decisions in light of recent cases in the lower courts and in the US Supreme Court that have affirmed biological reality.

Our state laws and policies should reflect a sincere effort to make students feel safe in school. Allowing biological boys to invade girl’s spaces does not accomplish this goal. Gender-confused children need real help and hope from those who will share the truth, not affirm their confusion. The Seventh Circuit should heed WILL’s advice and put an end to such policies.

Deputy Council on the case, Luke Berg, explained, "Neither Title IX nor the Constitution requires schools to ignore biology. Sex-separated bathrooms have long been justified to protect safety and privacy, especially for young girls. We hope the Court corrects its flawed decisions."
