Pro-freedom Wisconsin legislators proposed a constitutional amendment last session that might appear as a referendum on a statewide 2026 ballot. The amendment would alter Article I, Section 18 of the state Constitution to include a provision that would protect the right of places of worship to remain open during any declared state of emergency. The resolution had a hearing in the Assembly last week. The proposal passed both the Senate and the Assembly last session and needs to pass again this session before becoming a ballot question.
